These Terms of Service ("Terms") govern your access to and use of shop.bebaronial.com (the "Store") and any purchases you make from it. The Store is owned and operated by be Baronial Ladies' Garments Trading CO. L.L.C (trading as "Be Baronial", "we", "us", or "our"), a company licensed by the Department of Economy and Tourism, Dubai, United Arab Emirates (Trade License No. 1290328).

By accessing the Store or placing an order, you confirm that you accept these Terms and agree to be bound by them. If you do not agree, please do not use the Store.

1. Eligibility

The Store is intended for customers aged 18 and over. By placing an order, you confirm that you are at least 18 years old and legally able to enter into a binding contract.

2. Products

We sell women's activewear and related items. We take care to describe and display our products accurately, but:

  • Colours, textures, and details may appear differently depending on your device or screen, so actual products may vary slightly from images shown.
  • Product descriptions, sizing, and specifications are provided for guidance and may be updated from time to time.
  • All products are subject to availability. We reserve the right to limit quantities or discontinue any product at any time.

3. Pricing and Payment

  • All prices are displayed in UAE Dirhams (AED) and are inclusive of any applicable Value Added Tax (VAT), unless stated otherwise at checkout.
  • Prices, promotions, and product availability may change at any time without notice.
  • Payment is processed securely through our checkout provider, Shopify, and its integrated payment processors. We do not store your full payment card details.
  • We reserve the right to correct any pricing errors, even after an order has been submitted. If a product's correct price is higher than the price shown, we will contact you before dispatch to confirm whether you wish to proceed.

4. Orders and Order Acceptance

  • Placing an order constitutes an offer to purchase. Your order is accepted only when we send you an order confirmation or dispatch your items — whichever comes first.
  • We reserve the right to refuse or cancel any order, including where a product is out of stock, where we suspect fraud or unauthorised activity, or where a pricing or product error has occurred. If we cancel an order that has already been paid, we will refund you in full.

5. Shipping and Delivery

Shipping options, timeframes, and costs are set out in our Shipping Policy. Delivery timeframes are estimates and are not guaranteed. Risk of loss and title for items pass to you upon delivery.

6. Returns, Exchanges, and Refunds

Your rights to return, exchange, or receive a refund for products are set out in our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms affects your statutory rights under UAE Federal Law No. 15 of 2020 on Consumer Protection and its implementing regulations.

7. Promotions and Discount Codes

From time to time we may offer discount codes, welcome offers, or other promotions. Unless stated otherwise:

  • Codes are valid for a limited time, may be single-use, and cannot be combined with other offers.
  • Codes have no cash value and cannot be exchanged for cash.
  • We reserve the right to modify, suspend, or cancel any promotion, and to withdraw or void a code where we reasonably suspect misuse or fraud.

8. Reviews and User-Generated Content

If you submit a review, rating, photo, or other content to the Store ("Content"):

  • You confirm that the Content is your own, is accurate, and does not infringe the rights of any third party or breach any law.
  • You grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt the Content in connection with the Store and our marketing.
  • You must not submit content that is unlawful, offensive, misleading, or that impersonates another person.
  • We may moderate, decline to publish, edit, or remove any Content at our discretion.
  • Where we offer an incentive (such as a discount code) for a review, participation is subject to the terms stated at the time, and any incentive is issued at our discretion.

9. Intellectual Property

All content on the Store — including the Be Baronial name, logo, wordmark, taglines, product designs, images, graphics, text, and layout — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any of it for commercial purposes without our prior written permission.

10. Acceptable Use

You agree not to:

  • Use the Store for any unlawful, fraudulent, or harmful purpose.
  • Attempt to gain unauthorised access to the Store, its systems, or other users' data.
  • Interfere with or disrupt the operation, security, or integrity of the Store.
  • Use automated means to scrape, copy, or collect data from the Store without our consent.

11. Disclaimers

The Store and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding the Store's availability, reliability, or that it will be error-free or uninterrupted. This does not exclude any warranties that cannot be excluded under applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential loss arising from your use of the Store or any products purchased. Nothing in these Terms limits our liability where it cannot lawfully be limited, including liability under mandatory UAE consumer protection law.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising from your breach of these Terms or your misuse of the Store.

14. Third-Party Links and Services

The Store may link to or rely on third-party websites and services (including our payment, hosting, shipping, and email providers). We are not responsible for the content or practices of third parties, and your use of their services may be subject to their own terms.

15. Privacy

Your use of the Store is also governed by our Privacy Policy, which explains how we collect and handle your personal data.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest version. Your continued use of the Store after any changes constitutes acceptance of the revised Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
